From repair facilities submitting claims on our platform, we may also collect:

  • Repair facility name, address, and contact information
  • Service advisor name and contact information
  • Uploaded documents including estimates, invoices, diagnostic reports, and photos
  • Data extracted from those documents (e.g., line items, labor rates, part numbers, service dates)
  • Submission metadata including date, time, and device information

3. How We Use Your Information

We use the information we collect to:

  • Evaluate, process, and authorize claims under your Toco vehicle service contract
  • Communicate with you about your account, coverage, claim status, or service updates
  • Maintain service history records to support your coverage and future claims
  • Share claim documentation with our carrier, Technology Insurance Company (a subsidiary of AmTrust Financial Services), for audit, reserve, or reinsurance purposes
  • Detect and prevent fraud or misrepresentation
  • Improve our products, website, and claims processes using aggregated, de-identified data
  • Personalize your experience on our website and deliver relevant content
  • Comply with legal or regulatory obligations

4. What We Will Never Do With Your Information

  • Technology Insurance Company / AmTrust Financial Services - as our contract obligor and carrier, for audit and reserve purposes
  • Independent inspection services - when a physical inspection is required to evaluate a claim
  • Legal counsel, regulators, or government agencies - when required by law, to prevent fraud, or in connection with a legal dispute
  • Third-party platforms like Salesforce - for account management and customer service tracking

None of these parties are authorized to use your information for their own marketing or commercial purposes.

Billing information is handled through a secure third-party payment processor with its own privacy policy. We do not store or share your payment details beyond what is required to process your transaction.

6. Repair Facility Submissions

When a repair facility submits a claim on behalf of a customer, that facility confirms that:

  • The vehicle owner is an active Toco contract holder
  • The facility is authorized to submit the claim
  • The information provided is accurate to the best of their knowledge

The repair facility agrees indemnify, defend and to hold Toco Warranty harmless from any claims, damages, regulatory fines or liabilities arising out of the facility's failure to secure such consent or its unauthorized processing of customer data., from unauthorized disclosure of customer information or misrepresentation in the claim submission.

7. How Long We Keep Your Information

We retain claim-related data for a minimum of seven (7) years following the final closure of the claim or the expiration of the vehicle service contract, whichever is later - or as required by applicable law. Retention period is based on standard statutory record-keeping obligations for vehicle service contracts (e.g., 7 years). We reserve the right to deviate from this schedule where necessary to comply with specific state insurance department mandates or to fulfill contractual duties to our underwriters.

Repair facilities may request confirmation of documents on file for a specific claim by contacting us using the information in Section 11.

8. How We Protect Your Information

We use a combination of technical, physical, and administrative safeguards to protect your data. Uploaded files and transmitted data are encrypted via HTTPS and stored in access-controlled environments.

That said, no method of online transmission is 100% secure. We do our best to protect your information, but we cannot guarantee absolute security for data transmitted over the internet. Any transmission is at your own risk.

Your online account password is your responsibility. Toco Warranty is not liable for unauthorized account activity resulting from a lost, stolen, or disclosed password. Use the forgot password link to reset it at any time.

9. Your Rights & Choices

You have the right to:

  • Request confirmation of what information Toco holds about you
  • Request correction of inaccurate information
  • Request deletion of your information, subject to legal retention requirements
